Overview & Responsibilities

IDLO IN SOMALIA

IDLO has extensive experience and a good track record of implementing successful rule of law programmes in Somalia. Since 2012, IDLO has been working with government authorities at both the federal and state levels as well as key justice institutions and the informal justice system to enable them to fulfill their core functions, improve governance and strengthen access to justice for citizens, particularly for the most vulnerable. IDLO’s activities in the country aim to promote the rule of law in Somalia across several areas, including governance, institution building, policy and legal reform, access to justice, and human rights. In its programmatic work, IDLO has developed a strong partnership with a broad range of Government stakeholders at the Federal level, including the Office of the Presidency, the Office of the Prime Minister, the Office of the Chief Justice, the Attorney General’s Office, the Ministry of Justice (among other ministries), the Somali Bar Association, the Financial Reporting Center, as well as the Federal Member States (Puntland, Jubaland, Southwest, Galmudug, and Hirshabelle).

THE PROGRAMME

IDLO, with funds from the U.S. Department of State, Bureau of International Narcotics and Law Enforcement Affairs (INL), is implementing a 2-year programme called the “Somalia Justice Support Programme.” The SOMJUST responds to the national priorities, as outlined in the 2020-2024 National Development Plan, and aims to contribute to enabling criminal justice institutions to deliver efficient, equitable, and accessible justice services to Somali citizens (Goal).

The overall goal of this programme will be achieved through six mutually reinforcing objectives:

  • Objective 1 - The Judicial Training Institute (JTI) is the national leader for judicial training activities in Somalia.
  • Objective 2 - Federal and federal member state prosecutors and investigators work together to prosecute complex crimes.
  • Objective 3 - Somalia Corrections deliver effective and rights-abiding correctional services.
  • Objective 4 - The Somalia Bar Association becomes a self-governing body.
  • Objective 5 - Forensic activities in Somalia are conducted in a harmonized way and In line with the National Forensic Plan.
  • Objective 6 -the Revised Criminal Procedure Code is submitted to the Cabinet.

THE ASSIGNMENT

The consultancy falls within the framework of IDLO’s engagement to enable Somalia's criminal justice institutions to deliver effective, efficient, accessible, and accountable justice services to Somali citizens (Goal). The Corrections Consultant will work in collaboration with the SOMJUST programme team, the Ministry of Justice, and Constitutional Affairs (MOJCA), and other stakeholders.

The incumbent will report to the Technical Legal Advisor. The position will be provided over 7 months from 15 May 2023 – 15 December 2023.

Summary of Functions

  1. With the guidance of MOJCA, support the Somali Custodial Corps to develop a sectoral strategic plan, undertake training needs assessment, develop intstitutional documents and training materials for Somali Custodial Corps.

Key Results Expected

  1. During a National Corrections Workshop in Mogadishu, perform three tasks (1) undertake a training needs assessment of custodial corps officers to determine training needs (both basic and specialized) in coordination with IDLO and MOJCA (2) undertake an assessment of operational challenges that can guide the development of a standard operation procedurse (SOPs) manual and a revision in the Somali Custodial Corps’s organizational structure and (3) Lead a discussion on the development of the Sectoral Strategic Plan.
  2. Based on the outcome of the discussions at the national workshop as well as other bilateral meetings, develop a (1) a Sectoral Strategic Plan (2) a SOP Manual for Operations and Maintenance (O&M) and (3) an organizational structure for the Somali Custodial Corps, working closely with the MOJCA during the drafting process. The consultant will be expected to partake in consultation meetings organized through the Technical Coordinator of MOJCA.
  3. Complete IDLO’s Basic Training of Trainer’s (TOT) online course to ensure that training manuals produced under this consultancy align with IDLO’s adult training methodology.
  4. Based on the outcome of the training needs assessment, develop training materials for Corrections Officers in Somalia, including training manuals, that are based on IDLO’s adult training metholody. The number of training manuals will depend on the outcome of the training needs assessment and the availability of funds.

Skills and qualifications

Education and Work Experience

  • University degree in law, criminal justice, or a related field;
  • Fifteen (or more) years of work experience in international organizations on legal reform, human rights, and/ or governancel or, alternatively, fifteen or more years on managing prison/ corrections systems;
  • Proven experience in drafting operation manuals and reorganization;   
  • Proven experience in developing strategic plans;
  • Proven experience drafting curricula for the corrections officers;
  • Work experience in post-conflict settings is preferable;
  • Work experience in Somalia is highly desirable.
