Terms of Reference

Somalia continues to experience recurrent climate shocks with conflicts and drought that is causing forced displacement. With more 3.8 million[1] estimated internally displaced throughout the country, of these, 2.2 million require urgent humanitarian assistance. New displacements continue with 1.8 million persons displaced in 2022 according to PRMN reports. Luuq and Beletweyne continue to receive large influx of new drought-displaced persons on a daily basis. Luuq is one of the largest receiving IDP hubs with in Jubaland with more than 25,326 persons[2] arriving since January last year. Luuq hosts 34 IDP sites accommodating 8,233 households[3] or 51,028 individuals as of March 2022. Beletweyne also continues to receive huge displacement and is the country’s worst flood-affected district generally. According to CCCM cluster mapping in February, there are 119 IDP sites hosting 16,333 displaced households in Beletweyne.

It is important to highlight that the severe drought situation in Somalia has continued to increase the Housing, Land and Property (HLP) challenges which are confronting displaced communities in Luuq and Beletweyne.   Due to the influx, many newly drought and conflict displaced households are joining existing IDP settlements as a coping mechanism with unclear tenure arrangements, which are putting them at further risk of forced evictions.

The violation of HLP rights, in the form of forced evictions, remains a major negative factor affecting the overall protective environment for newly drought-displaced populations, thereby perpetuating social marginalisation and preventing IDPs and the wider local community from accessing potential durable solutions. Furthermore, the lack of adequate housing in overcrowded IDP settlements has exposed women and children to protection risks such as gender-based violence including rape and physical assaults. IDPs in both Luuq and Beletweyne are experiencing lack of access, and enjoyment to Housing, Land and Property (HLP) rights due to the following ; i)  continued high risk of forced evictions, ii) lack of tenancy agreements, ii) lack of local technical and function capacity of the local authorities and local dispute resolution committees  and iv) Lack of knowledge of HLP rights and how to exercise them amongst IDPs and marginalised groups.

Consultancy objective

As part of NRC’s HLP projects in Beletweyne and Luuq, an assessment to understand the HLP needs of DACs in Beletweyne and Luuq has been carried out. The main objective of the needs assessment was to identify the needs related to Housing, Land and Property (HLP) rights for the IDPs, returnees and the host communities in both locations to inform HLP interventions.  The assessment also examined the current situation for the displaced people in terms of tenure security and access to related tenure rights on exercising HLP particularly, having a home, free from the fear of forced eviction. The research methodology consists of three primary components: an extensive desk review, semi-structured KIIs, and fieldwork (through a household survey and focus group discussions).

During this assessment, NRC collected diverse data; NRC aims to work with a consultant responsible for analysing the data collected and producing an in-depth report with precise qualitative analysis. As the information will influence and shape NRC programming activities on housing, land, and property rights.

Consultancy Deliverables

• Analysis of raw data collected and literature review.
• Update the available date where the context changed including additional cases.
• Well-written 25-20-page final report on HLP needs assessment.
• Prepare a PowerPoint presentation summarising the process and outcomes of the report.

• At least 3 years of expertise in field research, particularly qualitative methodology and data analysis; field research in urban areas is essential.
• At least 3 years of expertise in quantitative research, particularly in analyzing survey data from statistical sources.
• Experience with report writing for development partners and/or Government.
• Experience and understanding of the Somali/ Horn of Africa context.
• Understanding HLP issues in Somalia would be an added advantage.

APPLICATION PROCEDURES AND REQUIREMENTS

 The consultant/consulting firm interested are expected to provide following documentation:

1. A cover letter introducing the consultant. In the case of a firm, the cover letter should introduce the team composition and specify the role to be played by each team member.
2. A technical proposal of not more than 10 pages outlining how to execute the task with a clear framework and methodology. Proposed methodology should demonstrate a clear understanding of the ToR (proposed methods and tools)
3. Company profile and resume of the consultant, or each team member from the firms
4. Proven track record of developing similar reports from INGOs and UN.
5. Proposed budget indicating consultancy fee in USD.
6. Reference letters and the contact of at least three referees (email and telephone).
7. Proof of registration from the country of origin as a limited liability company or as a sole trader/self-employed.
